Peers reserves the right to change the terms of this Agreement at any time, without prior notice, by posting here. You will be bound by any such changes if you continue to use the Website after such changes are posted. We encourage you to review the Website and this Agreement from time to time to determine whether a revised Agreement has been posted. The date of the last revision appears at the end of this Agreement.
Description of Services
Peers provides a variety of online tools and resources that support individuals across the world who work and earn money in the sharing economy. Peers Community Forums is an online forum that allows you to connect with other people who earn money in the sharing economy so you can explore shared challenges and issues. Peers Support Marketplace provides links to third party providers that offer products and services, and gives you the opportunity to purchase certain products and services directly from Peers, that can help you simplify your life, stabilize your experience and maximize your earnings. Peers Income Discovery helps you find and assess new work opportunities in the sharing economy and gives you a place to post ratings, talk about your experience working for different sharing economy companies, including your earnings, and view other people’s experiences. Peers Petitions allows anyone to start campaigns to grow and protect the sharing economy.
In order to access the Website and create an account, you must be at least 18 years of age or older. Accordingly, by creating an account, you represent and warrant that you are at least 18 years of age or older, and are fully able and competent to enter into the terms, conditions, representations and warranties set forth in this Agreement; otherwise, please exit the Website.
Persons who are at least 13 years of age but under the age of 18 are not eligible to create an account, but may access certain public areas of the Website that are accessible without creating an account with the consent of a parent or legal guardian. Accordingly, by accessing the Website, you warrant that you are at least 18 years of age or older, or are at least 13 years of age and have received consent from your parent or legal guardian, and are fully able and competent to enter into the terms, conditions, representations and warranties set forth in this Agreement; otherwise, please exit the Website. If you are a parent or guardian of a child who is at least 13 years of age, but under the age of 18, and you give your child permission to use the Website, you hereby agree to the terms set forth in this Agreement on behalf of both yourself and your child. You further agree that you are solely responsible for any and all use of the Website by your child regardless of whether such use was authorized by you.
Become a Member
In order to make a purchase in the Peers Support Marketplace, participate on Peers Community Forum and/or Income Discovery create a campaign using Peers Petitions, or to take certain other actions through the Website, you will must become a member of Peers. Peers membership is only available to persons 18 years of age or older who are registered service providers with one or more eligible sharing economy companies.
In order to join Peers as a member, you must create an account and provide certain personal information, including your first and last name, email address, and location. You will also be asked to provide a list of the companies with which you are registered as a service provider. You must provide information about yourself that is true, current and complete, and keep this information up-to-date. Peers reserves the right to contact the sharing economy platforms you list in order to verify any information you provide in connection with your membership. Peers also reserves the right to suspend or terminate your membership if Peers has reason to believe that you have supplied inaccurate or intentionally misleading information, including, but not limited to, information regarding your company affiliations.
In order to create your account, you will be asked to select a username and password. You agree that you will not select a username: (a) belonging to another person or entity with the intent to impersonate that person or entity; (b) that violates the rights of any third party, including intellectual property rights and/or rights of publicity; or (c) that Peers, in its sole discretion, deems inappropriate or offensive. You acknowledge and agree that you shall have no ownership or other property interest in your user name or account, and you further acknowledge and agree that all rights in and to your user name and account (but not in the personally identifying information associated therewith) are and shall forever be owned by and inure to the benefit of Peers.
You are solely responsible for maintaining the confidentiality and security of your username and password on the Website, and are responsible for all activities (whether by you or by others) that occur under your password or account. You must notify us immediately of any unauthorized use of your account. Peers will not be liable for any loss or damage arising in connection with any unauthorized use of your account. Peers reserves the right to reclaim any user name for any reason, and to refuse any request to create an account or to login for any reason or no reason.
Our Website includes a Blog (“the Blog”) that permits Users to link to and repost Blog content to their social media networks, via the Tumblr interface. The views expressed in Blog posts and comments belong solely to their respective authors and do not necessarily reflect the views of Peers.
The Blog may contain general information and opinions regarding legal, tax, insurance, or other similar issues relating to the sharing economy that may be of interest to Peers members. The Blog is provided as a convenience for Peers members and for general informational purposes only. The information posted to the Blog is not intended, and does not, constitute legal or tax advice or a legal opinion upon which a User may rely. Without limiting the foregoing, please note that the Blog may not reflect recent changes in the law or tax code, and may be inaccurate or may not be applicable to the laws of the jurisdiction in which you live. You should not act or refrain from acting on the basis of any information or advice contained in the Blog without seeking the appropriate legal or other professional advice based on the particular facts and circumstances at issue from an attorney or other professional licensed your state. Peers expressly disclaims all liability in respect to actions taken or not taken based on information or content posted to the Blog.
Peers Community Forums
Peers Community Forums allows you to post questions and respond to other questions from Users regarding shared challenges and issues faced in earning income in the sharing economy. Peers does not actively monitor the activity on Peers Community Forums, but reserves the right, in its sole discretion to delete questions or responses that it becomes aware of that are not relevant to the topic, or are otherwise in violation of this Agreement.
Peers Income Discovery
Peers Income Discovery helps people find and assess new work opportunities in the sharing economy and allows you to rate various sharing economy companies that you have worked with, to post reviews describing your experience, and to post information regarding your earnings. Peers lists Platforms in accordance with its Sharing Economy Platform Listing guidelines.
Peers may receive compensation from certain Companies when you click a link in Peers Income Discovery and register to provide service on a Company platform, or take certain other actions on a Company’s website with the intention of finding and assessing new work opportunities in the sharing economy. Peers will disclose from which companies we may receive compensation by describing them as “featured” in Peers Income Discovery. Please rate only companies with which you have actually worked as a provider – Peers Income Discovery is not intended for customer or user reviews of sharing economy companies. While you are encouraged to share your opinions, please make sure that your reviews are factually accurate and based on first-hand experience. Peers does not actively monitor or review User Content posted, but reserves the right, in its sole discretion, to remove any User Content posted to Peers Income Discovery that it determines, in its sole discretion, to be in violation of this Agreement and/or the Peers Ratings and Review Guidelines.
Peers Support Marketplace, Peers Products
The Peers Support Marketplace provides links to purchase certain products directly from companies (“Companies”) that Peers has identified as offering products that may be useful to Peers members. Peers offers these links as a service to its members. Peers may receive compensation from certain Companies when you click a link in the Peers Support Marketplace, purchase a product from a Company, or take certain other actions on a Company’s website. Peers will disclose from which companies we may receive compensation by describing them as “featured” in Peers Support Marketplace. Aside from this compensation arrangement, Peers has no affiliation with the Companies, and makes no warranties or guarantees with respect to any Company or any product offered by a Company. In particular, Peers makes no warranties or guarantees with respect to the quality, usefulness, or suitability of any product offered by a Company.
In order to purchase a product from a Company, you will be taken directly to the Company’s website, and Peers’s terms, practices, and policies will no longer apply. We encourage you to review the posted policies of any Company from whom you choose to purchase products. Peers makes no warranties or guarantees with respect to the security of any information, including financial information, that you share with a Company, and shall not be liable for any loss you sustain as a result of any transaction between you and a Company.
Peers Support Marketplace, Peers Products
You hereby agree that, for all payment transactions, (1) you will not use an invalid or unauthorized credit or debit card or other payment method; and (2) payment transactions will be charged to the credit or debit card or other payment method you use through Stripe; and (3) all payment transactions are final and non-refundable.
Peers Petitions, Prohibited Campaigns
It is a violation of this Agreement to create a campaign or to upload or transmit any content or information that promotes hatred, violence, discrimination or stereotypes based on race, gender, ethnicity, sexuality, or religion, or that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable, or that may invade another’s right of privacy or publicity, or that includes statements in support of, or in opposition to, any candidate for public office. Peers reserves the right, in its sole discretion, to edit and/or remove any campaign or any content uploaded or transmitted in connection with a campaign that it finds to be in violation of this Agreement.
Peers does not endorse or authorize any user-created campaigns on the Website, and does not actively monitor or review campaigns or content posted to the Website. However, if we become aware of a campaign or content that Peers determines, in its sole discretion, violates this Agreement or may be offensive, illegal, defamatory, or infringes the rights, or threatens the safety, of others, or is otherwise objectionable, Peers reserves the right, without notice, to edit and/or remove the campaign or content in question.
You warrant that all text, images and other content you post or submit to the Website, including to Peers Community Forums and/or Income Discovery (“User Content”) is your original work and/or to the extent that the User Content includes any text, images or other content owned by a third party, you warrant that you are licensed to use and reproduce such content on the Website. You accept all liability for any issues that may arise from such User Content. Please do not submit any images or photographs for which you do not have a current model or property release unless you are otherwise authorized to post such material. The views expressed in User Content, including ratings and reviews posted to Peers Community Forums, Peers Income Discovery, Peers Support Marketplace, and/or Peers Petitions, belong solely to their respective authors and do not necessarily reflect the views of Peers. Peers does not rate or review Platforms or Partner Companies.
By submitting and posting User Content to the Website, you grant to Peers a perpetual, irrevocable, worldwide, royalty-free and non-exclusive license to use, modify, reproduce, publish, broadcast, display and distribute the User Content in any format, using any medium, for the purpose of promoting Peers, your campaign, or the sharing economy movement, or for any other purpose that Peers deems appropriate.
Peers does not actively monitor or review User Content posted to the Website, but merely provides a technology platform that allows Users to post information and content and interact with other Users who have an interest in the sharing economy. You will, if asked by a representative of Peers, cease posting any User Content, and/or links to content, deemed offensive, objectionable, or in poor taste. If Peers becomes of aware of any User Content that, in its sole discretion, violates this Agreement, or may be fraudulent, misleading, offensive, illegal, defamatory, or infringes the rights, or threatens the safety, of others, or is otherwise objectionable, Peers reserves the right, without notice and in its sole discretion, to edit and/or remove the User Content in question.
You understand and acknowledge that any questions, comments, suggestions, ideas, feedback or other information that you submit to Peers, whether via email or via a form provided on the Website (“User Submissions”), are not confidential and become the sole property of Peers, and that Peers shall own the exclusive rights, including copyrights and any other relevant intellectual property, in the User Submissions.
Copyright and Trademark Policy
Except where otherwise noted, Peers owns, or is the licensee of, all intellectual property rights in and to the Website, including all content, text, photos, videos, images, source code, and trademarks (“Website Content”). Peers encourages you to share links to Website Content through your social media network, including by using the Tumblr “reblogging” feature. However, if you would like to make any other use of the Website Content, including publishing excerpts from the Blog or other Website Content, please contact us at email@example.com for permission. Commercial use of any Website Content is strictly prohibited without prior authorization from Peers.
If you believe that any Website Content violates or infringes upon your intellectual property rights pursuant to Title 17, United States Code, Section 512(c)(2), please notify us immediately at firstname.lastname@example.org with all specifics necessary for us to consider and respond to your complaint. You may be asked to provide additional information and follow additional procedures for us to act on your complaint.
Links to Other Websites and Content
The Website may contain links to other websites (“Third Party Sites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, software and other content belonging to or originating from third parties (the “Third Party Content”). Peers does control or monitor such Third Party Sites and Third Party Content, and cannot be held responsible for any Third Party Sites accessed through the Website or any Third Party Content encountered on the Website, including without limitation the content, accuracy, offensiveness, opinions, reliability or policies of or contained in the Third Party Sites or the Third Party Content. Inclusion of or linking to any Third Party Site or any Third Party Content does not imply approval or endorsement thereof by Peers. Peers shall not be responsible or liable, directly or indirectly, for any damages or losses caused or alleged to be caused by or in connection with your use of or reliance on any Third Party Site or any Third Party Content. If you choose to navigate from the Website to any Third Party Sites, including Third Party Sites operated by Companies, you acknowledge that you do so at your own risk and that Peers’s terms, practices, and policies no longer apply. You should review the applicable terms and policies, including privacy policies and practices, of any Third Party Site to which you navigate from the Website.
You are solely responsible for your interactions with other Website Users. Peers reserves the right, but has no obligation, to monitor disputes between you and other Users, and to delete the accounts of Users who engage in or escalate disputes with other Users.
The Website is only to be used for lawful purposes, and in ways that do not infringe or restrict the rights of others or their use of the Website. You acknowledge and agree that you shall not use or attempt to use this Website (i) for any unlawful, unauthorized, fraudulent or malicious purpose; (ii) in a manner that could damage, disable, overburden, or impair any server, or the network(s) connected to any server; (iii) to interfere with any other party’s use and enjoyment of the Website; (iv) to gain unauthorized access to any other accounts, computer systems or networks connected to any server or systems through hacking, password mining or any other means; (v) to access systems, data or information not intended by Peers to be made accessible to the general public or Website Users; (vi) to attempt to obtain any materials or information through any means not intentionally made available by Peers; or (vii) for any purpose other than the purposes for which the Website was intended by Peers.
In addition, in connection with your use of the Website, you agree you will not:
a) post or submit any User Content or User Submission, or upload or transmit any message, information, data, text, software or images, or other content that is, or could be considered, unlawful, harmful, threatening, abusive, inflammatory, harassing, tortious, defamatory, vulgar, obscene, libelous, hate speech, or otherwise objectionable, that may invade another’s right of privacy or publicity, or that is knowingly false, misleading, or inaccurate;
b) post any other person’s identifying information (including their names, contact information or any other relevant information) within the Website but your own;
c) engage in personal attacks or any type of “flaming,” or “troll” other users (for example, by posting topics or opinions that are designed to provoke a negative response from one or more specific users);
d) create a false identity for the purpose of misleading others or impersonate any person or entity, including, without limitation, any Peers representative, or falsely state or otherwise misrepresent your affiliation with a person or entity;
e) upload or transmit any material that you do not have a right to reproduce, display or transmit under any law or under contractual or fiduciary relationships (such as nondisclosure agreements);
f) upload or distribute files that contain viruses, trojan horses, worms, time bombs, cancel-bots, corrupted files, or any other similar software or programs that may damage the operation of another’s computer or property of another, or that are designed to do harm to or allow unlawful access to any computer hardware, software, networks, or any other systems;
g) delete any author attributions, legal notices, or proprietary designations or labels on any User Content that you upload to, or transmit via, the Website;
h) use the Website’s communication features in a manner that adversely affects the availability of its resources to other users;
i) upload or transmit any unsolicited advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes” or any other form of solicitation, commercial or otherwise, or collect personal information about Website users for the purpose of sending them any such advertisements, chain letters, pyramid schemes, or solicitations through other means;
j) upload or transmit any materials or information that include statements in support of, or in opposition to, any candidate for public office;
k) violate any applicable local, state, national or international law;
l) upload or transmit any material that infringes any patent, trademark, service mark, trade secret, copyright or other proprietary rights of any party;

Warranty Disclaimers and Limitation of Liability
You understand and agree that your use of the Website is at your sole risk. While we do our best to keep our site functioning and free of bugs, Peers does not warrant that the functions and content on the Website will be free of interruptions, errors, viruses, or bugs, or will operate on all devices or operating systems, or that any such problems will be corrected. All content, information, materials, services, and anything else on or linked from the Website are provided on an “As Is” or “As Available” basis. Peers makes no warranty or guarantee about the truthfulness, accuracy, completeness, or adequacy of the Blog, the Website Content, User Content, or any materials, resources or other information contained in or linked to the Website, and users relying thereon do so at their own risk.
Peers expressly disclaims all warranties and conditions with respect to the Website, whether implied, express, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement of third-party rights, satisfactory quality, quiet enjoyment and accuracy.
In addition to the above warranty disclaimers, you understand and agree that Peers will not be liable for any loss of profit, loss or corruption of data, special, exemplary, punitive, incidental, indirect or consequential loss or damages suffered or incurred or arising in connection with the Website, or your use or inability to use the Website, or in connection with any act or omission by us (negligent or otherwise), even if Peers has been advised of the possibilities of those damages. You understand and agree that your use of the Website is predicated upon your waiver of any right to sue Peers and its affiliates directly or to participate in a class action suit for any losses or damages resulting from your use of the Website.
Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.
Children Under 13
This Website is intended solely for users who are thirteen (13) years of age or older, and any registration by, use of or access to the Website by anyone under 13 is unauthorized, unlicensed and in violation of this Agreement. In its sole discretion, Peers may terminate your account, delete your account information and any content or information that you have posted on the Website, and/or prohibit you from using or accessing the Website, or any portion thereof, for any reason, at any time, and with or without notice to you, if it believes that you are under 13. Notwithstanding any terms in this Agreement to the contrary, if you are in a jurisdiction in which the minimum age permissible by law to use the Website is greater than 13, all references to 13 in this section shall instead be replaced with the minimum age permitted in your jurisdiction.
Misprints and Errors
Peers endeavors to provide current and accurate information on our Website. Nevertheless, errors and misprints occur. Accordingly, Peers reserves the right to reject, correct, cancel or terminate any transaction for which the price or offer details were incorrectly displayed or for which any other erroneous or inaccurate information was provided. Peers reserves the right to do this at any time during the transaction process, including after a transaction has been submitted and even if the transaction has been confirmed. Under no circumstances is Peers obligated to process or complete any transaction based on any error, misprint or otherwise.
Peers shall not be liable for any failure or delay in performance due in whole or in part to any cause beyond the reasonable control of Peers, including a delay in services from its contractors, agents or suppliers, and also including but not limited to utility or transmission failures, power failure, strikes or other labor disturbances, acts of God, acts of war or terror, floods, sabotage, fire, natural or other disasters.
Governing Law & Venue and Jurisdiction
By visiting or using the Website, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern this Agreement and any dispute of any sort that might arise between you and Peers or any of our affiliates. Any dispute pertaining to this Agreement, except those disputes subject to binding arbitration, shall be brought exclusively in a court of competent jurisdiction in San Francisco, California.
Any controversy or claim arising out of or relating to this Agreement, except for temporary, preliminary, or permanent injunctive relief or any other form of equitable relief as to which the parties submit to the exclusive jurisdiction of the courts in San Francisco, California, shall be settled by binding arbitration in San Francisco, California, and administered by the American Arbitration Association (“AAA”) or similar arbitration body and conducted by a sole arbitrator in accordance with the AAA’s Commercial Arbitration Rules or the arbitration rules of a similar arbitration body. The arbitration shall be governed by the Federal Arbitration Act, codified in chapter 1 of Title 9 of the United States Code, as amended, to the exclusion of state laws inconsistent therewith or that would produce a different result, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof. Except as may be required by law or to the extent necessary in connection with judicial challenge, or enforcement of an award, neither a party nor the arbitrator may disclose the existence, content, record or results of an arbitration.
Before commencing any action pertaining to a controversy or claim arising out of or relating to this Agreement, the party wishing to commence the action shall provide reasonable notice to the other party before commencing the action, in order to allow the parties an opportunity to resolve the dispute before resorting to legal action.
You agree to defend, indemnify, and hold harmless Peers, and its affiliates, and all of their respective directors, officers, employees, representatives, proprietors, partners, shareholders, servants, principals, agents, predecessors, successors, assigns, accountants, and attorneys from and against any and all suits, actions, claims, proceedings, damages, settlements, judgments, injuries, liabilities, obligations, losses, risks, costs, and expenses (including, without limitation, attorneys’ fees and litigation expenses) relating to or arising from your use of this Website, the use of any Third Party Sites or Third Party Content, the purchase of any goods or services from Companies, the uploading, transmitting, downloading, or use of User Content, your reliance on any errors or omissions on the Website, your fraud, violation of law, or willful misconduct, and any breach by you of this Agreement as stated herein or as modified from time to time in Peers’s sole discretion.
This Agreement constitutes the entire agreement between you and Peers regarding the use of the Website, superseding any prior agreements between you and Peers relating to your use of the Website. The failure of Peers to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision in that or any other instance. If any provision of this Agreement shall be deemed invalid, unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions, and the remainder of this Agreement shall continue in full force and effect
